Welcome to NEXT-GEN Hospitality Staffing. NEXT-GEN focuses on delivering employment services and exchange programs through a mission-driven approach.

Our goal is to protect your privacy, and this Privacy Policy ("Policy") will help you understand how we collect and process Personal Information from those who use our websites (e.g., https://www.nextgen-hospitality-staffing.us), applications, mobile apps, blogs or related online and offline services we offer (collectively, the "Services"). This Policy also outlines our policy on what we will and will not do with the information we collect, and your choices regarding the collection and use of your information. If you have a business relationship with us, or if you receive Services from us, a separate agreement may be required (for instance, with your employer, the contractual terms of that relationship will govern in the event of any conflict).

You (or in the case of NEXT-GEN Hospitality Staffing Programs or Employment Services, your employer) may provide Personal Information to us which may include your name, home and/or work email address, postal address, phone number and/or fax number, your employer and job title, demographic information about you including birth year, certification designation, etc.

Through our Services, NEXT-GEN Hospitality Staffing has the ability to receive information in various ways, such as:

Other Registration: When registering for specific other services, such as subscribing to an email newsletter.

Exchange Visitor Program Applications: When participating in NEXT-GEN Hospitality Staffing Exchange Programs, Host Organizations (the entity hosting an exchange visitor) and Exchange Visitor Trainees/Interns (the foreign individual) must provide NEXT-GEN Hospitality Staffing with Personal Information as necessary to process the applications and operate the program. NEXT-GEN Hospitality Staffing's collection and use of information for this program may vary over time due to applicable laws and regulations. In addition to the terms of this Privacy Policy, Personal Information associated with the NEXT-GEN Hospitality Staffing Exchange Visitor Program is subject to the Exchange Visitor Program Privacy Policy and any terms that have been agreed upon with the Host Organization.

Employment Applications: NEXT-GEN Hospitality Staffing collected relevant personal information from job applicants, including a resume or CV and any other information required to verify qualifications and assess suitability for an available position.

Events: NEXT-GEN Hospitality Staffing may receive information about you when you participate in any events we host, organize or sponsor, both online (e.g., webinar) or offline (e.g., conferences).

Interactions: We receive information through communications between you and us, such as via email, web form, mail, phone, or other channels.

If you provide us with information regarding another individual (such as a colleague or co-worker), you represent that you have their consent to give us their information and to permit us to use the information in accordance with this Policy.

When you use online NEXT-GEN Hospitality Staffing Services, we receive certain technical information about your use of the Services, which may be associated with your personal information in some instances. NEXT-GEN Hospitality Staffing collects technical information when an individual visits any online NEXT-GEN Hospitality Staffing Services including IP address, browser type and version, time zone settings, browser plug-in types and versions, operating system and platform.

We may also collect information about the visit, including pages and content viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information, and methods used to browse to or away from the page. NEXT-GEN Hospitality Staffing may also receive location information where you choose to provide the Services with access to information about your location. This technical information can be necessary to provide the Services, and it also helps us determine which portions of Services are most popular and which part of the website people have visited.

We can also use such information to deliver customized content and advertising to users of the Services whose behaviour indicates that they are interested in a particular subject area, and measure the effectiveness of advertisements and web searches. In order to collect certain online user activity, our services use cookies and other commonly-used web technologies.

For the purpose of targeted advertising, user analytics, and providing you with a more personalized experience and special offers, we may share certain Personal Information with third parties we engage with. There is also an option to opt back in to targeting cookies.

Our Services are operated, evaluated, and improved using Personal Information, including for the following purposes:

  • We will fulfill our obligations that arise from your Exchange Visitor sponsorship, and any other agreement we may have entered into with you, or in the event of NEXT-GEN Hospitality Staffing Programs, Employment Services, a relationship exists between your employer and us,

  •   To provide you with the information, and services you request from us,

  •   To organize and deliver conferences and events related to your program or job and subjects of interest,

  •   To respond to your questions and provide related customer services,

  •   For our business purposes, such as data analysis, audits, developing new products and features, enhancing our website, improving our services, identifying usage trends, and determining the effectiveness of our promotional campaigns,

  • To notify you about changes to your services or to ask you to provide feedback,

  •   To administer and protect our business and websites (including troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data),

  • For those who apply for employment with NEXT-GEN
    Hospitality Staffing, we will process your employment application, including background checks, education, and employment verification, as applicable,

  • To abide by all laws, legal processes, industry standards, our policies, and contractual rights,

  • For any other purpose specified at the point of collection or as described in your express authorization.

We may use and disclose non-personal, non-individual statistics or demographic information in a de-identified or aggregate form without restriction.

The NEXT-GEN Hospitality Staffing Services may also include forums, bulletin boards, discussion lists, and/or moderated chats. Any information disclosed in these areas becomes public information with no expectation of confidentiality, and you should exercise appropriate caution when deciding to disclose your Personal Information or post any other information in these areas.

NEXT-GEN Hospitality Staffing will not disclose your Personal Information to third parties without your consent except as described below:

When you provide Personal Information through the Services for a particular service or promotion, such as when registering for a NEXT-GEN Hospitality Staffing-organized event, NEXT-GEN Hospitality Staffing may share certain limited information (e.g., title, contact information) derived from such registrations with third parties (e.g., event sponsors), who may contact you directly regarding their services;

We may disclose information about you: (1) if we are required to do so by law or legal process; (2) when we believe disclosure is necessary to prevent harm or financial loss; (3) in connection with an investigation of suspected or actual fraudulent or illegal activity; or (4) under exigent circumstances to protect the personal safety of our staff, NEXT-GEN clients, or the public; and we reserve the right to transfer the information that we maintain in the event of a contemplated or actual sale or transfer of all or a relevant portion of our business or assets. If such an event occurs, we will make reasonable efforts to direct the recipient to use your Personal Information in a manner that is consistent with this Policy.

We may share your information as permitted by law, including, for instance, with legal affiliates and service providers that we believe need the information to perform a technology, business, or other professional function for us (for instance, IT services, maintenance and hosting of our Services, event facilitators, marketing partners, and other service providers). We provide such vendors with information so that they can perform their required functions on our behalf, in accordance with this Privacy Policy and applicable law.

If you are a participant in NEXT-GEN Hospitality Staffing Exchange Visitor Program, you must provide Personal Information about yourself and any dependent family members on the sponsorship application. NEXT-GEN Hospitality Staffing is required by law to provide your Personal Information to the U.S. Department of State and Department of Homeland Security (NEXT-GEN Hospitality Staffing does not disclose Personal Information related to the Exchange Visitor Program except as necessary to process the application, operate the program, and provide the sponsorship to you and your Host Organization).

Information provided in an application for employment with NEXT-GEN Hospitality Staffing may be disclosed as reasonably necessary to verify past education and employment qualifications, perform background checks and as otherwise required by law or NEXT-GEN Hospitality Staffing policy.

NEXT-GEN Hospitality Staffing does not disclose sensitive Personal Information such as social security numbers, credit card numbers, felony conviction information, or health information except as necessary to complete transactions requested by you, to process employment applications, or to comply with legal obligations, all under availability confidentiality and security protections. We offer you certain choices about what information we collect from you, how we use and disclose the information, and how we communicate with you.

Opting-Out of Marketing Emails: From time to time, we may contact you via email or through other channels for the purpose of providing announcements, promotional information and/or other general communication. In order to improve our Services, we may be notified when you open an email from us or click on a link therein. You may choose not to receive marketing emails from us by clicking on the unsubscribe link in the marketing emails you receive from us.

Please note that it may take some time for your request to be fully processed. Even if you opt out of receiving such communications, we may continue sending you non-marketing email communications, such as administrative or information about changes to our terms of service.

Opting-Out of Messages: If you affirmatively consent to receive text messages from us and enroll in such a program, you will receive updates via text unless you opt-out of the text message program. These messages may be unencrypted. Message frequency may vary based on the Services. If at any time you would like to stop receiving text message notifications, please text "STOP" in reply to our message, we will send you a reply message to confirm that you have been unsubscribed and you will no longer receive messages from us. If you want to join again, just sign up as you did the first time and we will start sending messages to you again. If at any time you forget what keywords are supported, just text "HELP" back to us and we will respond with instructions on how to use our service as well as how to unsubscribe.

Cookies: As noted above, our Services allows users to opt-out of certain third party cookies. In addition, web browsers may offer users the ability to disable receiving certain types of cookies; however, if cookies are disabled, some features or functionality of our Services may not function correctly.

Targeted Advertising: As noted above, we may work with advertising partners who collect information about your online activities and provide you with choices regarding the use of your browsing behavior for purposes of targeted advertising.

In addition to the privacy rights described above, if you are a resident of California, Colorado, Connecticut, Delaware, Iowa, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Texas, Utah or Virginia (or Tennessee as of July 1, 2025, Minnesota as of July 31, 2025, or Maryland as of Oct. 1, 2025), you may have a right to subject certain specific requests regarding your Personal Information, as provided below.

You may request a copy of the following: (1) the categories of Personal Information we collected about you; (2) the categories of sources from which the Personal Information is collected; (3) the business or commercial purpose for collecting or selling (if applicable) the Personal Information; (4) the categories (or in some states, the identity) of third parties with whom we shared Personal Information, and the categories of Personal Information shared; and (5) the specific pieces of your Personal Information that we have collected, used, disclosed, or sold.

You may request that we (and our service providers) correct your Personal Information if it is inaccurate or delete your Personal Information. Note that deletion requests are subject to certain limitations, for example, we may retain Personal Information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, to process transactions and facilitate user requests, and for certain other internal business purposes described in this Policy.

You may authorize another person (your "agent") to submit a request on your behalf the same way. Shortly after you (or your agent) submit a request, we will check our records for matching information and contact you (via email at the email address provided during submission of your request) with instructions on how to verify the request before we fulfill it.

We will aim to complete your requests as soon as reasonably practicable and consistent with any applicable laws.

You also have the right at any time to opt out of (1) selling or sharing of your Personal Information to third parties, and (2) targeted advertising through third parties.

Privacy laws may provide you with other opt-out rights which are inapplicable to us. In particular, we do not engage in impactful profiling activities with respect to users, and we do not collect, use or disclose sensitive Personal Information (such as government identification number, precise geolocation, financial account credentials, etc.) except for the specific purpose(s) that you provide it.

We may not, and will not, discriminate against any individual for exercising their privacy rights, including those provided by the applicable privacy laws. Please note that we may otherwise continue to share your Personal Information with our affiliates and service providers, and as otherwise directed by you, for the purposes described in this Policy.

If we deny a privacy request, you may appeal the decision to us at the contact information provided below or in our denial notice. To the extent possible, please describe the basis for your appeal and if there is any specific Personal Information that concerns you. We will endeavor to provide a prompt response and within the timeframe provided by any applicable law.

We also collect information through our Internet files, which record data such as IP addresses, browser types, domain names, and other anonymous statistical data involving the use of the Sites. This information may be used to analyze trends, to administer the websites, to monitor the use of the websites, and to gather general demographic information. We may link this information to Personal Information for these and other purposes such as personalizing your experience on the websites and evaluating the websites in general.

"Do Not Track" is a privacy preference that users can set in certain web browsers. We do not comply with automated browser signals regarding tracking mechanisms, which may include "do not track" instructions.

Our Services are not directed to minors under the age of 16 and we do not knowingly collect or sell the Personal Information of minors under 16.

We implement and maintain strong reasonable security appropriate to the nature of the Personal Information that we collect, use, retain, transfer, or otherwise process. Our strong security program is implemented and maintained in accordance with applicable law and relevant standards. However, reasonable security is a process that involves risk management rather than risk elimination. While we are committed to developing, implementing, maintaining, monitoring, and updating a strong information security program. Data security incidents and breaches can occur due to vulnerabilities, criminal exploits or other factors that cannot reasonably be prevented. Accordingly, while our reasonable security program is designed to manage data security risks and thus help prevent data security incidents and breaches, it cannot be assumed that the occurrence of any given incident or breach results from our failure to implement and maintain reasonable security.

California Civil Code Section 1798.83, also known as the "Shine the Light" law, permits California residents to annually request, free of charge, information about the Personal Information (if any) disclosed to third parties for direct marketing purposes in the preceding calendar year. We may use Personal Information to market third party services we believe may be of interest to our customers and we may share Personal Information with third parties for their own marketing purposes.

If you exercise any of your rights described in this Privacy Policy, we will continue to treat you fairly.

Policy Changes

We will review and update this Policy as required to keep current with rules and regulations, new technologies and security standards. We will post those changes on the website or update the Privacy Policy modification date below. In certain cases, and if the changes are material, you will be notified via email or a notice on our website.
